Three Drywall Coverage Actions Denied Transfer to MDL 2047

WASHINGTON, D.C. - For the fifth time, the Judicial Panel on Multidistrict Litigaiton has refused to transfer a group of declaratory judgment actions to the Chinese Drywall MDL in New Orleans. In Re: Chinese-Manufactured Drywall Products Liability Litigation, MDL No. 2047 (JPML).

The latest attempt by Taylor Morrison Inc. and Lennar Corp. to bring coverage cases into MDL 2047 was rejected by the JPML on Oct. 7 after the panel determined that insurer opposition to the motion and lack of benefit derived from transferring the cases favor keeping the cases in the courts where they were originally filed.
