MDL Judge Remands JPML-Transferred Insurance Coverage Action

NEW ORLEANS - Chinese Drywall MDL Judge Eldon E. Fallon has remanded an insurer's declaratory judgment action that was the first and last such case transferred to him by the Judicial Panel on Multidistrict Litigation. Owners Insurance Co. v. Mitchell Company Inc., et al., No. 10-1036 (E.D. La.).

In a Sept. 9 order, the U.S. District Court for the Eastern District of Louisiana said that remand of the case brought by Owners Insurance Co. and its affiliate was necessary because of recent rulings by the JPML panel denying MDL transfer of several drywall-related coverage suits.
