BAY MINETTE, Ala. - A state court judge in Alabama has granted a motion to reconsider a decision to dismiss personal injury allegations from a Chinese drywall lawsuit that plaintiffs had initially filed as a class action. Langham, et al. v. ACE Home Center Inc., et al., No. CV-2009-900948 (Ala. Cir., Baldwin Cty.).
Judge James H. Reid of the Baldwin County Circuit Court granted the motion Aug. 25, without comment, after the plaintiffs argued that recent amendments to their complaint rendered their injury claims recoverable under Alabama law.
