Drywall Maker Says Court Lacked Jurisdiction to Render $2.7 Million Default

NEW ORLEANS - Taishan Gypsum Co. Ltd. has asked the Chinese Drywall MDL court to vacate a $2.7 million default judgment entered against the Chinese company in a case brought by several Virginia homeowners. Germano, et al. v. Taishan Gypsum Co. Ltd, et al., No. 09-6687 (E.D. La.).
The Aug. 3 motion says that Taishan does not have sufficient minimum contacts with Virginia to establish jurisdiction over the foreign defendant and that the default should be set aside and the case dismissed because Taishan was never properly served with the complaint upon which the judgment was based.
