MDL Judge Denies Attorneys' Fees Request in Germano

NEW ORLEANS - The Federal MDL judge has refused to award attorneys' fees in the wake of the $2.6 million default judgment entered earlier this year against Chinese drywall manufacturer Taishan Gypsum Co. Germano, et al. v. Taishan Gypsum Co., Ltd., et al., No. 09-6687 (E.D. La.).

In an order entered Aug. 5, Judge Eldon E. Fallon of the U.S. District Court for the Eastern District of Louisiana held that because the plaintiffs' fee request was based solely on a violation of the Virginia Consumer Protection Act, which is inapplicable to the claims against Taishan Gypsum, plaintiffs are not entitled …
