NORFOLK, Va. - Builders Mutual Insurance Co. has filed a declaratory judgment action, arguing that pollution and your work exclusions contained in commercial liability policies it sold to two builders bar coverage for a Chinese drywall suit brought against the insureds. Builders Mutual Insurance Co. v. The Futura Group LLC, et al., No. 10-324 (E.D. Va.).
The July 2 complaint filed in U.S. District Court for the Eastern District of Virginia contends that allegations in the underlying lawsuit for property damage and bodily injury were caused by conditions that the two endorsements were intended to exclude.
