RICHMOND, Va. - A Virginia homeowner who suffered what a judge deemed a direct physical loss resulting from Chinese drywall, but was denied coverage for the damage based on exclusions in his homeowner's policy, has appealed the ruling. Ward v. TravCo Insurance Co., No. 10-1710 (4th Cir.).
Larry Ward filed a notice of appeal June 24 in the 4th Circuit U.S. Court of Appeals, asking the panel to determine whether the trial judge erred in his decision to award summary judgment to Travco Insurance Co. based on application of the exclusions and related legal standards.
