MIAMI - A Florida contractor that built several luxury homes that contain allegedly defective Chinese Drywall has sued its insurer for refusing to cover potential damages and provide a defense against at least four lawsuits against the company. CDC Builders Inc. v. Amerisure Mutual Insurance Co., No. 10-21678 (S.D. Fla.).
CDC Builders Inc. sued Amerisure Mutual Insurance Co. May 24 in U.S. District Court for the Southern District of Florida, seeking a declaration that the insurer must provide coverage for the claims under a series of commercial general liability policies issued to the contractor between 2005 and 2009.
