Court Denies Knauf Appeal of Economic Loss Ruling

MIAMI - An appeals court has refused Knauf Plasterboard (Tianjin)'s effort to reverse a decision denying the Chinese drywall manufacturer's motion to dismiss property damage claims based on the Florida Economic Loss Rule. Knauf Plasterboard (Tianjin) Co., Ltd. v. Lennar Homes LLC, et al., No. 3D10-166 (Fla. Ct. App., 3rd Dist.).
Florida's Third District Court of Appeal denied Knauf's petition for writ of certioriari on April 22, disposing of the defendant's bid to limit recovery of damages in cases where the plaintiff allege economic damages caused by defective drywall.
