Allstate Moves to Sever 1st-Party Coverage Claims in Louisiana

NEW ORLEANS - Allstate Insurance Company has moved to sever first-party coverage claims included against the insurer in a lawsuit brought by a Louisiana homeowner who allege that their home was ruined by Chinese drywall. Boutte v. E. Jacob Construction Inc., et al., No. 10-1464 (E.D. La.).

Allstate says in a motion filed May 13 in U.S. District Court for the Eastern District of Louisiana that the homeowner's claims fail to satisfy requirements for joining the insurer to a complaint that also includes allegations against the builder and supplier that arise from improper construction and sale of the plaintiff's home.
