SAN FRANCISCO - A developer seeking insurance coverage for drywall claims has filed a petition for writ of mandamus in a federal appeals court in California, arguing that a trial judge erred when it agreed to transfer the case to Florida. In RE: Taylor Morrison Inc., No. 10-71045 (9th Cir.).
In its April 5 petition before the 9th Circuit U.S. Court of Appeals, Taylor Morrison Inc. claims that the U.S. District Court judge who granted insurer Chartis Specialty Insurance Co.'s motion to transfer venue ignored most of the undisputed facts that pointed the case away from Florida.
