NEW ORLEANS - Banner Supply Co. has filed a motion in the Chinese Drywall MDL, asking the court to halt cases brought by plaintiffs who filed duplicative claims for damages in both state and federal courts. In Re: Chinese-Manufactured Drywall Products Liability Litigation, MDL No. 2047 (E.D. La.).
The March 10 motion requests that U.S. District Court Judge Eldon E. Fallon issue an order enjoining duplicative state court actions, or staying or dismissing the federal cases that are now part of the MDL in Judge Fallon's Eastern District of Louisiana court.
