LAS VEGAS - A putative class of Nevada residents have responded to a motion by Georgia-Pacific to dismiss their recently amended complaint, which they say has adequately pled claims for personal injury caused by defective drywall. Moniz, et al. v. US Home Corp., et al., No. A-09-597564 (Nev. Dist. Ct., Clark Cty.).
In a brief filed March 3 in Clark County District Court, the plaintiffs counter that their allegations against Georgia-Pacific are not based on fraud, which would have required a heightened pleading standard advocated by the defendant.
