FORT MYERS, Fla. - Florida couple that filed one of the first insurance-related Chinese drywall claims has moved to dismiss the action, stating that it is no longer economically feasible to pursue their homeowner's insurer for coverage of drywall-related damage. Baker, et al. v. American Home Assurance Company Inc., No. 09-188 (M.D. Fla.).
In a Feb. 16 motion to dismiss filed in U.S. District Court for the Middle District of Florida, Keith Baker and Linda Leri say they learned last week that their mortgage company has refused to enter into a forbearance agreement to relieve them of their payment obligations.
