TAMPA, Fla. - Auto-Owners Insurance Company has responded to an insured's request to cover costs associated with replacing defective wallboard installed in Florida homes by filing a declaratory judgment action arguing that coverage is barred by pollution and "your work" exclusions. Auto-Owners Insurance Co. v. American Building Materials Inc., et al., No. 10-313 (M.D. Fla.).
The Michigan-based insurer filed the action Jan. 28 in U.S. District Court for the Middle District of Florida, arguing there is no applicable coverage under two policies issued to American Building Materials Co. for home allegedly damaged by drywall supplied by ABM.
