Excess Insurers File Action Over Coverage of Banner Supply Drywall Claims

TAMPA, Fla. - Chartis Specialty Insurance Co. and two other insurers that provided umbrella coverage to Banner Supply Co. have filed a complaint in federal court arguing they have no duty to defend or indemnify the company against claims related to defective Chinese drywall. Chartis Specialty Insurance Co., et al. v. Banner Supply Co., No. 10-339 (M.D. Fla.).

The declaratory judgment action was filed Feb. 2 in U.S. District Court for the Middle District of Florida and cites numerous exclusions in the policies as reasons why the insurers have no obligation to cover claims against Banner Supply.
