RICHMOND, Va. - A North Carolina-based insurer has filed a declaratory judgment action against the developer of a Richmond, Va., home that was allegedly damaged by defective drywall. Builders Mutual Insurance Co. v. Parallel Design & Development LLC, et al., No. 09-800 (E.D. Va.).
Builders Mutual Insurance Co. filed the suit Dec. 17 in U.S. District Court for the Eastern District of Virginia and contends that it owes no duty to defend or indemnify its insured for any claims or damages associated with drywall damage asserted by the homeowner.
