OCALA, Fla. - Georgia Pacific and 84 Lumber have filed motions in Florida, arguing that a class action filed against them for damages caused by defective drywall not manufactured in China should be thrown out for failure to adequately plead any cause of action. Swidler, et al. v. Georgia-Pacific Gypsum LLC, et al., No. 09-181 (M.D. Fla.).

Separate motions to dismiss were filed by the defendants Jan. 13 in U.S. District Court for the Middle District of Florida, where Michael and Jill Swidler filed a class action in May 2009 for damages allegedly caused by Georgia-Pacific's ToughRock drywall, which the …
