RICHMOND, Va. - Nationwide Mutual Insurance Co. has asked a federal judge to determine its obligation obligations for damage, and at least one lawsuit, related to allegedly defective drywall installed in a condominium complex in Virginia. Nationwide Mutual Insurance Co., et al. v. The Overlook LLC, et al., No. 10-37 (E.D. Va.).
The Ohio-based insurer filed a declaratory judgment action Jan. 19 in U.S. District Court for the Eastern District of Virginia, arguing that it doesn't have a duty to duty to defend or indemnify Overlook LLC against claims by a condo owner who purchased property built by the company. …
