Class Certification Sought In Wake of Taishan Preliminary Default

NEW ORLEANS - The Mitchell Co. has filed a motion to certify a class of builders who want Chinese drywall manufacturer Taishan Gypsum to pay for repairs and other damages sought by residents whose homes have been damaged by Taishan's allegedly defective product. The Mitchell Company Inc. v. Knauf Gips KG, et al., No. 09-4115 (E.D. La.).
According to a Jan. 7 motion for class certification, Mitchell says the class is seeking a judicial declaration that any costs incurred by builders as a result of defective Taishan drywall should be borne by the manufacturer.
