MIAMI - American Home Assurance Company has filed a declaratory judgment action in Florida asking the court to rule that it has no obligation to defend or indemnify a condominium owner for damages related to Chinese drywall. American Home Assurance Co. v. Peninsula II Developers Inc., et al., No. 09-23691 (S.D. Fla.).
The Dec. 11 lawsuit in the U.S. District Court for the Southern District of Florida argues that the damages claimed by American Home Assurance's insured aren't covered because of exclusions in the policies and because coverage wasn't in effect at the time the alleged damage occurred. The insurer …
