NEW ORLEANS - Home improvement retailer Lowe's has asked the federal Chinese drywall MDL judge for a release from the coordinated proceedings, arguing that the only plaintiffs to name the company as a defendant don't have imported drywall in their home. Dempster v. Lowe's Home Centers Inc., No. 09-5482 (E.D. La.).
Lowe's filed the motion to deconsolidate from the MDL on Nov. 12, citing information gathered from a report generated after Barry and Annette Dempster's Des Allemands, La., home was inspected in compliance with MDL procedures.
