NEW ORLEANS - A drywall supplier has filed a motion for summary judgment that, if granted, would limit plaintiffs' potential damages against the company to the amount paid for the allegedly defective material, plus interest. In Re: Chinese-Manufactured Drywall Products Liability Litigation, MDL No. 2047 (E.D. La.).
Interior Exterior Building Supply filed the motion Sept. 28 in U.S. District Court for the Eastern District of Louisiana, arguing that if evidence uncovered during discovery reveals the company was unaware that Chinese drywall it sold was defective, it cannot be found liable for damages caused by the product.
