USG, L&W Supply Seek Sanctions in Fla. Drywall Cases

MIAMI - USG Corp. and L&W Supply Corp. have filed motions for sanctions in several Florida drywall cases, arguing that plaintiffs who brought property damage claims against the companies did so without supporting evidence that either company actually sold the product installed in the plaintiffs' homes. Acuna, et al. v. Lennar Corp., et al., No. 2009-29324-CA-27 (Fla. Cir. Ct., Miami-Dade Cty.).
The request for fees and costs associated with defending dozens of Miami-Dade Circuit Court cases were filed Aug. 18, along with an affidavit indicating that L&W sales records don't match the addresses of the plaintiffs who filed the cases.
