Domestic Drywall Plaintiffs Say New Complaint Moots Dismissal Efforts

OCALA, Fla. - A putative class of residents whose homes were allegedly damaged by defective, but domestically manufactured, drywall have filed an amended complaint they say renders moot recent efforts by Georgia-Pacific Gypsum and 84 Lumber to dismiss the case. Swidler v. Georgia-Pacific Gypsum LLC, et al., No. 09-181 (M.D. Fla.).
The Amended complaint and corresponding response to the defendants' motions to dismiss were filed Aug. 31 in the U.S. District Court for the Middle District of Florida, where defendants moved to dismiss or abate the class action last month.
