Contractor Moves to Dismiss Lennar Lawsuit Pending in Miami

MIAMI - A contractor named in a lawsuit Lennar Homes brought against manufacturers, suppliers and distributors of allegedly defective drywall has moved to dismiss the case, saying that it should be filed in one of the three counties where the majority of affected homes are located. Lennar Homes LLC v. Knauf GIPS KG, et al., No. 09-07901-CA-23 (Fla. Cir. Ct., Miami-Dade Cty.).
Florida Style Services Inc. filed the forum non conveniens motion to dismiss July 24 in Miami-Dade County Circuit Court, arguing that the case would be fairly and more conveniently litigated in Lee, Sarasota or Hillsborough Counties.
