Judge Says Drywall Replacement Offer Must Note Effect on Legal Rights

TAMPA, Fla. - A federal magistrate has granted a plaintiffs' motion for protective order that sought to preclude a homebuilder from contacting potential class members with offers to replace defective drywall in their homes. Culliton v. Taylor Morrison Services, et al., No. 09-589 (M.D. Fla.).
However, Judge Thomas G. Wilson of the U.S. District Court for the Middle District of Florida granted the motion only to the extent that defendant Taylor Morrison Services must notify homeowners of their right to consult an attorney prior to consenting to the agreement.
