COLUMBUS, Ohio - A dispute that arose in an Ohio class action over whether a builder may contact homeowners with offers to replace allegedly defective drywall has been resolved ahead of a hearing on the plaintiff's motion for a preliminary injunction. Minafri, et al. v. M/I Homes, et al., No. 09-167 (S.D. Ohio).
In a June 1 stipulation and proposed order, plaintiffs in the U.S. District Court for the Southern District of Ohio indicated their intent to withdraw the motion "given developments in the case" against M/I Homes Inc.
