NEW YORK - AIU Insurance Co. is not required to provide its reinsurer with certain documents generated by AIU's coverage counsel because they are protected under the attorney-client privilege, a New York federal magistrate judge has ruled in an asbestos coverage case. AIU Insurance Co. v. TIG Insurance Co., No. 07-7052 (S.D. N.Y.).

In a Nov. 25 order, Magistrate Judge Henry Pitman of the U.S. District Court for the Southern District of New York held that AIU has not waived privilege because it has not taken any affirmative act to place the privileged communications at issue and the reinsurer has …
