4-Star Restaurant’s COVID-19 Coverage Action Remanded to N.J. State Court

CAMDEN, N.J. — A federal judge has remanded a four-star restaurant’s COVID-19 business interruption coverage action, ruling that the case implicates unsettled questions of New Jersey insurance law which should be resolved by a state court.

In a Nov. 25 opinion, Judge Anne E. Thompson of the U.S. District Court for the District of New Jersey explained that disposition of the action “will require careful application of New Jersey public policy in an unfamiliar context.”
