Hotel Investor Sues Endurance American for COVID-19 Business Losses

LOS ANGELES — An investor in several hotels that were forced to suspend operations as a result of the COVID-19 pandemic, including a Boston Marriott which was the site of the first “super spreader” event in the United States, has sued Endurance American Specialty Insurance Co., demanding coverage for its losses.

In a Nov. 16 complaint filed in the U.S. District Court for the Central District of California, Sunstone Hotel Investors Inc. contends that its policy covers economic losses resulting from “Biological Agent Conditions,” which are defined to specifically include the presence of “viruses and other pathogens.”
