Railroad Co. Seeks Declaratory Relief, Injunction Against Reinsurer in Ill. Federal Court

SPRINGFIELD, Ill. — Union Pacific Railroad Co. has asked an Illinois federal judge to enjoin a reinsurer from suing it for reimbursement for mine subsidence claims, arguing that the parties had already litigated the issues in two previous actions and entered into a settlement resolving future claims.

In an Oct. 20 complaint filed in the U.S. District Court for the Central District of Illinois, Union Pacific has asserted claims for declaratory judgment and injunctive relief against Illinois Mine Subsidence Insurance Fund (IMSIF).
