Pa. Diner Says COVID-19 Losses Covered Under Nationwide Policy

PHILADELPHIA — A Pennsylvania diner has sued Nationwide General Insurance Co. and Nationwide Mutual Insurance Co. in federal court, demanding coverage for COVID-19-related losses it sustained when it was forced to close its dining room in compliance with government COVID-19 shutdown orders.
In an Oct. 19 complaint filed in the U.S. District Court for the Eastern District of Pennsylvania, KWB Enterprises Inc. d/b/a West Main Diner says that as a result of the virus and the shutdown orders, it suffered “direct physical loss or damage” as defined by the policy.
