NEW YORK — In a newly filed lawsuit, a Manhattan retail and apartment complex says Affiliated FM Insurance Co. has breached its property insurance policy by denying coverage for $227,565 in rental losses caused by the COVID-19 pandemic and related government stay-at-home orders.
In a complaint removed to the U.S. District Court for the Southern District of New York on Oct. 6, Herald Towers LLC says it has sustained “physical loss or damage” to its insured property, triggering coverage under its policy’s provisions for business interruption and civil authority coverage.
