FORT WORTH, Texas — An insurance agent has opposed Greenlight Reinsurance Ltd.’s motion to dismiss its lawsuit claiming the reinsurer is barred from seeking a return of premiums for a reinsurance agreement, arguing that the dispute "is ripe and justiciable" and does not require further fact development.
In an Oct. 2 response filed in the U.S. District Court for the Northern District of Texas, Contractor Managing General Insurance Agency Inc. (CMGIA) contends that the dispute needs to be resolved because it has arisen between the parties every year for the last 10 years.
