ATLANTA — A federal appeals court has dismissed a cedent’s appeal of an order requiring arbitration of a reinsurance dispute arising from a $7.2 million construction defects settlement, ruling that the order was not “final or appealable.”

The 11th Circuit U.S. Court of Appeals dismissed Builders Insurance’s appeal on May 11.

Builders Insurance (a Mutual Captive Company), American Builders Insurance Co., and National Builders Insurance Co. (“Builders,” collectively) issued five successive, annual commercial general liability insurance policies to Vista Ridge Development LLC beginning in 2011.
