Odyssey Re’s Fraudulent Transfer Claims Against Claims Adjustor, CEO to Proceed

SAN DIEGO — A California federal judge has refused to dismiss fraudulent transfer claims asserted against a claims adjustor and its chief executive officer in an action in which Odyssey Reinsurance Co. seeks payment of a $3.2 million judgment.

In an April 22 order, Judge Barry Moskowitz of the U.S. District Court for the Southern District of California found Odyssey’s evidence raises questions of fact as to whether David Dostalik and Claim Technology Services Corp. (CTS) transferred funds owed to Cal-Regent Insurance Services Corp.
