5th Cir. Denies Rehearing En Banc in Schiff Hardin Attorney Immunity Case

NEW ORLEANS — A federal appeals court has refused to reconsider its decision that a law firm is immune from negligent misrepresentation claims in a product liability action because the attorneys were acting within the scope of their representation of a client, and therefore the attorney immunity defense applies.

On Feb. 7, the 5th Circuit U.S. Court of Appeals denied a motion for rehearing en banc, refusing to disturb its ruling that all of Schiff Hardin LLP’s alleged misrepresentations were related to its representation of an insurer’s policyholder.
