OMAHA, Neb. — Applied Underwriters Inc. has opposed a motion for class certification filed by a former participant in its EquityComp workers’ compensation program, arguing there is a lack of commonality and the movant’s claims are not typical of the class it seeks to represent.

In a Jan. 11 opposition filed in the U.S. District Court for the District of Nebraska, AUI further argues movant Top’s Personnel Inc. does not possess the “diligence, wisdom and integrity” required of a class representative and is in fact a defunct corporation.
