Utica Says N.Y. Federal Judge Properly Denied Century’s Summary Judgment Motions

UTICA, N.Y. — Utica Mutual Insurance Co. has opposed a reinsurer’s request that a New York federal judge reconsider his denial of its motion for summary judgment in a dispute over whether it must pay Utica’s defense costs, arguing that there are no “exceptional circumstances” warranting reconsideration.
In a Nov. 6 motion filed before Judge David Hurd of the U.S. District Court for the Northern District of New York, Utica contends that the judge properly rejected Century Indemnity Co.’s estoppel defense and correctly held that Utica has standing to assert claims based on a 1975 reinsurance certificate.
