Florists Insurance Opposes Reinsurers’ Late Notice Defense, Moves for Partial Summary Judgment

NEW YORK — Florists’ Insurance Co. has opposed Endurance Assurance Corp.’s motion for summary judgment in a reinsurance dispute involving a 2008 deadly trucking accident, arguing that it timely notified Endurance of the underlying claim.

In its opposition filed in the U.S. District Court for the Southern District of New York, Florists further argues that Endurance failed to show that any alleged late notice of the claim cause it any actual prejudice. Florists cross-moved for partial summary judgment on the timeliness issue.
