Century Asks Judge to Reconsider Denial of its Summary Judgment Motions in Dispute with Utica

UTICA, N.Y. — Century Indemnity Co. has asked a New York federal judge to reconsider his denial of its motion for summary judgment on the issue of whether it is bound by a mid-term endorsement to Utica Mutual Insurance Co.’s 1973 umbrella policy, arguing that the issue was already litigated and resolved in a previous arbitration.

In its Oct. 10 motion filed before Judge David Hurd of the U.S. District Court for the Northern District of New York, Century further argues that Utica lacked standing to pursue an underlying claim arising from breach of a 1975 reinsurance certificate.
