NEW YORK — Endurance Assurance Corp. has moved for summary judgment in a reinsurance dispute involving a 2008 deadly trucking accident, arguing that its cedent, Florists’ Insurance Co., breached the policy by notifying the reinsurer of the loss 10 years too late.
In a Sept. 13 motion filed before Judge Lewis Kaplan of the U.S. District Court for the Southern District of New York, Endurance maintains that it was prejudicially deprived of its right to participate in the defense of the resulting insurance claim.
