Reinsurer Seeks Dismissal of Claims in Ala. Federal Disability Coverage Action

BIRMINGHAM, Ala. — A reinsurer/third-party administrator has moved to dismiss breach of contract claims filed against it in a disability coverage action, arguing that it was not a party to the policies issued by the insurer to the policyholder.

In an Aug. 1 motion filed in the U.S. District Court for the Middle District of Alabama, Standard Life Insurance Co. further maintains that the plaintiff did not plead his fraud claims with the requisite particularity and therefore they must be dismissed.
