Trial Briefs Filed in Dispute over Reinsurance Coverage for Goulds Asbestos Settlement

UTICA, N.Y. — Trial briefs have been filed in a dispute in which Munich Reinsurance America Inc. is challenging Utica Mutual Insurance Co.’s allocation of an underlying asbestos settlement on a pro rata basis and the insurer’s billing of declaratory judgment expenses above policy limits.

The trial briefs were filed June 5 in the U.S. District Court for the Northern District of New York before judge Brenda K. Sannes of the U.S. District Court for the Northern District of New York. Earlier this year, Judge Sannes denied the parties’ cross-motions for summary judgment on the allocation, expenses and reimbursement issues.
