FORT MYERS, Fla. — Munich Reinsurance America Inc. says it is not obligated to pay reinsurance proceeds to a Florida risk management pool for the $750,000 settlement of an underlying lawsuit, asserting the claims in that action are excluded from coverage.
However, in an April 18 answer filed in the U.S. District Court for the Middle District of Florida, the risk management pool asserts that the underlying claims fell within the scope of coverage and Munich is estopped from disclaiming liability.
