Applied Underwriters Ordered to Produce Documents, Info in Workers’ Comp Cases

SACRAMENTO, Calif. — A California magistrate judge has made a number of discovery rulings in two class actions concerning Applied Underwriters Inc.’s EquityComp workers’ compensation program, ordering the defendants to produce information concerning absent class members and its separate SolutionOne program.

In the Jan. 12 order, Magistrate Judge Allison Claire of the U.S. District Court for the Eastern District of California further ordered defendants to produce documents regarding submission of the EquityComp program’s reinsurance participation agreement with the California Department of Insurance in 2016, after the department and defendants were already in a dispute about the agreement’s legality.
