Odyssey Moves for Dismissal of Injunctive Relief Claim Against AmTrust

SAN DIEGO — Odyssey Reinsurance Co. and AmTrust North America Inc. have jointly moved a California federal court to dismiss a single claim for injunctive relief against AmTrust in an action seeking payment of a $3.2 million judgment in a reinsurance action.

In an Oct. 25 motion filed in the U.S. District Court for the Southern District of California, the parties seek dismissal of the claim without prejudice and on the condition that AmTrust abide by the court’s previous order requiring it to make certain “earn out” payments into the court registry.
