S.C. Federal Judge Dismisses Lawsuit Against U.S. Bank Trust for Lack of Personal Jurisdiction

COLUMBIA, S.C. — A South Carolina federal judge has dismissed for lack of personal jurisdiction a lawsuit accusing U.S. Bank Trust N.A. of breaching its duties as trustee of a reinsurance trust account, ruling that the bank lacked the requisite connections with the state.

In a Sept. 25, Judge J. Michelle Childs of the U.S. District Court for the District of South Carolina referenced the U.S. Supreme Court’s recent holding that a corporation’s continuous activity within a state “is not enough to support the demand that the corporation be amenable to suits unrelated to that activity.”
