Applied Underwriters Ordered to Pay $5,500 in Discovery Sanctions in RPA Dispute

OMAHA, Neb. — A Nebraska federal magistrate judge has ordered Applied Underwriters Inc. to pay $5,500 in sanctions for its failure to comply with a discovery order requiring it to provide information concerning a reinsurance participation agreement and a promissory note executed by the parties.

In a Sept. 5 order, Magistrate Judge Cheryl R. Zwart of the U.S. District Court for the District of Nebraska noted the $5,500 represents fees and costs incurred by Top’s Personnel Inc. in preparing its second motion to compel production of supplementary initial disclosures and the deposition of AUI’s vice president, Jeffrey Silver.
